Frequently Asked Party Wall Questions
A Party Wall Agreement, commonly known as a Party Wall Award, is a legally binding document prepared by appointed Party Wall Surveyor(s) under the Party Wall etc. Act 1996. It sets out how proposed building works will be carried out while protecting the interests of both neighbouring property owners.
You may need to serve a Party Wall Notice if you plan to build on or near a shared boundary, cut into a party wall, excavate close to a neighbouring property or carry out works covered by the Party Wall etc. Act 1996. Notices must usually be served before work begins.
If your neighbour dissents or does not respond within 14 days, a Party Wall Award will normally be required. Each owner may appoint their own surveyor, or both parties can agree to use a single Agreed Surveyor. The surveyor(s) will prepare an impartial Award to protect both parties.
Fees depend on the type and complexity of the project. At Smart Home Surveyors, Building Owner appointments start from £950, additional adjoining owners (joint appointments) are £350 each, and Party Wall Notices start from £150.
The process can vary depending on the project and your neighbour’s response. If neighbours consent, the process can be completed relatively quickly. If a Party Wall Award is required, it may take several weeks to prepare before works can legally commence.
If your proposed works fall under the Party Wall etc. Act 1996, you should not begin work without first following the correct legal procedures. Failing to do so may lead to delays, disputes or legal action.
A Party Wall Award typically includes details of the proposed works, access arrangements, working hours, methods of construction, and measures to protect neighbouring properties. It may also include a Schedule of Condition to record the neighbour’s property before work starts.
Not always. If both parties agree, a single Agreed Surveyor can act impartially for both owners. Alternatively, each owner may appoint their own surveyor, who will work together to prepare the Party Wall Award.
A Schedule of Condition is a detailed photographic and written record of the neighbouring property’s condition before work begins. It helps protect both parties by providing evidence should any damage be alleged during or after the works.
